Terms of Service

1. Acceptance of Terms

By accessing or using Capyvite ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use our Service.

2. Description of Service

Capyvite is an event RSVP platform that allows hosts to create event pages and collect attendee signups. We offer:

  • FREE tier: 3 events/month, 30 attendees/event
  • PRO tier ($9/month): 30 events/month, 100 attendees/event, CSV export, analytics, no badge

3. User Accounts

3.1 Registration

To create events, you must register with a valid email address. We use magic link authentication - no password required.

3.2 Account Responsibility

You are responsible for maintaining the security of your email account and for all activities under your Capyvite account.

3.3 Age Requirement

You must be at least 13 years old to use Capyvite. By using the Service, you represent that you meet this requirement.

4. Acceptable Use

You agree NOT to:

  • Post illegal, harmful, or offensive content
  • Spam or mislead attendees
  • Harass, threaten, or abuse other users
  • Impersonate another person or entity
  • Bypass security measures or rate limits
  • Scrape or automate access without permission
  • Sell or share attendee data without consent
  • Use the Service for commercial spam or phishing

5. Host Responsibilities

As an event host, you are responsible for:

  • Accurately describing your events
  • Respecting attendee privacy settings you configure
  • Complying with applicable laws (event permits, age restrictions, etc.)
  • Not discriminating against attendees based on protected characteristics

Capyvite is not responsible for events themselves - we only provide the RSVP platform.

6. Attendee Data

Attendee data belongs to the event host. Capyvite processes this data on behalf of hosts. Hosts must:

  • Use attendee data only for event-related purposes
  • Not sell or share attendee lists without consent
  • Respond to attendee data requests (access, deletion)

7. Payment Terms (Pro Tier)

7.1 Pricing

  • Monthly: $9/month
  • Yearly: $90/year (2 months free)

7.2 Billing

Payments are processed by Stripe. Your card is charged at the start of each billing period. We do not store your card details.

7.3 Cancellation

You may cancel your Pro subscription at any time. You'll retain Pro features until the end of your current billing period.

7.4 Refunds

We do not offer refunds for partial billing periods. If you have concerns, contact us at support@capyvite.com.

7.5 Failed Payments

If payment fails, you have a 21-day grace period. During this time, Pro features remain active. After 21 days, your account reverts to FREE tier.

8. Intellectual Property

8.1 Capyvite IP

The Capyvite platform, logo, design, and code are our intellectual property. You may not copy, modify, or distribute them without permission.

8.2 Your Content

You retain ownership of your event content. By using Capyvite, you grant us a license to display and store your content as needed to provide the Service.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

  • Uninterrupted or error-free service
  • That data will never be lost
  • That the service will meet all your requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • FREE tier: Our liability is limited to $0
  • PRO tier: Our liability is limited to the fees you paid in the last 12 months (maximum $108)

We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, data loss, or business interruption.

11. Indemnification

You agree to indemnify and hold Capyvite harmless from any claims arising from:

  • Your violation of these Terms
  • Your use of the Service
  • Your events or interactions with attendees
  • Any third-party claims related to your content

12. Termination

12.1 By You

You may delete your account at any time via Account Settings. There is a 30-day grace period during which you can recover your account.

12.2 By Us

We may suspend or terminate your account for violations of these Terms, with notice when possible. We reserve the right to remove content that violates our policies.

13. Dispute Resolution

13.1 Informal Resolution

Before filing any claim, please contact us at support@capyvite.com. We'll try to resolve the issue informally within 30 days.

13.2 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or prominent notice on the Service. Continued use after changes constitutes acceptance.

15. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Capyvite regarding the Service.
